This webinar will provide an overview of Ohio’s Developmental Disability System with an emphasis on areas that intersect with adult guardianship. Area of focus will include: Ohio’s developmental disability system structure ; eligibility for developmental disability services; appeals and advocacy within the developmental disability system; local, state and federal benefits available to persons with developmental disabilities; Medicaid waivers specific to persons with developmental disabilities; unique concerns for guardian’s of persons with developmental disabilities; and how to protect eligibility for benefits.

Presenter: Derek Graham is an estate planning attorney and partner at Resch, Root, Philipps & Graham, LLC in Dublin, Ohio. Derek’s practice focuses on estate planning, special needs planning, developmental disabilities law, guardianship, probate, probate litigation and business (organizational, transactional and succession). Early in his career he was fortunate to get experience in civil litigation, business transactions and estate planning. Then in 2009, he and his wife had their first daughter who was born with Down syndrome. Like many of his clients today, they were inundated with information and felt overwhelmed. Twelve years later, he now spends the majority of his days helping similarly situated families with the various resources that exist. Derek finds it very rewarding to help families understand how to effectively and practically plan their estate. More than that though, he enjoys helping families understand the resources available to them and how to get the most out of those resources.

Studies have shown that families and communities struggle with having conversations about end-of-life decisions, health care wishes, treatment options, living arrangements, and financial realities as people age. Sometimes these conversations are easy to avoid; sometimes they involve topics that are considered sensitive or private; sometimes they are fraught with misunderstanding and fear. As a result, many important decisions are made quickly and with limited input from those who are affected by them. In addition, services such as palliative care and hospice care, as well as the role of those providing other types of support at the end of life are often not utilized in a timely manner. This workshop provides a framework for facilitating such discussions among those nearing the end of life and their families; it discusses the concept of palliative care in the context of treatment in healthcare settings; it defines the types of care that can be provided through both community-based palliative care and hospice; and it spotlights the type of support that can be provided by an end-of-life Duala. This information can provide participants with a way to better prepare families to receive care at this very sensitive time of a person’s life.
